1. DEFINITIONS

"BNPP Cardif API" refers to the application programming interfaces that BNP Paribas Cardif makes available on the API Store at the address https://apistore.bnpparibascardif.com/. "Content" means any object code of the API Store, or any test data, BNPP Cardif API or any other data provided by BNPP Cardif in connection with the API Store. "Loss" means any direct or indirect loss, damage or expense, including any loss of profit, loss of revenue, loss of anticipated savings, loss of opportunity, loss of contract, loss of goodwill, loss of reputation, loss of fees, increase in labour costs, any indirect or consequential loss, or any loss arising from liability to any other person (and, in each case, whether the foregoing arises in contract, tort, negligence or otherwise). "Service" means any or all of the features that may be used and offered on the API Store. "Use" means a User's access to the API Store and/or their use of the Services. "User" means any person using the Services. "User Data" means all data and information relating to Users, which is transmitted and analysed by or on behalf of BNPP Cardif during the Use of the Services by Users, including their personal data within the meaning of these Terms.

2. FEATURES

You are responsible for making all arrangements necessary for you to use the Services, including, but not limited to, arranging and maintaining any technical equipment necessary for such use, and installing certain standard features. This equipment will remain at the expense of the User, as well as the communication costs incurred by his Use of the Services.

3. ACCESS AND REGISTRATION FOR THE SERVICE

3.1 ACCESS

If you are acting as an employee or on behalf of another person in connection with your use of the API Store, you must ensure that you are authorized to do so by your employer or that other person. Your use of the API Store and your acceptance of these Terms constitutes your personal representation and warranty that you are so authorized and have the authority to bind your employer or any other person to these Terms. You must also comply with all security measures implemented by your employer or other person to protect the API Store, and any systems or materials accessible through the API Store, from unauthorized access, alteration, destruction, corruption, or loss.

Access to certain portions of the services described on the API Store may be subject to other prohibitions or restrictions that apply to certain persons in certain countries/states. You must not use any part of the API Store to which prohibitions or restrictions apply, if you are not authorized to do so. By using the API Store, you represent and warrant that such use will not cause you, and/or cause BNPP Cardif, to violate any applicable law or regulation.

3.2 REGISTRATION

Registration Process

BNPP Cardif reserves the right to approve applications and may reject your application at its discretion without having to provide reasons. This is done at no extra cost. For more information on the data collected when you register to use the API Store, please refer to our Privacy Policy - BNP Paribas (group.bnpparibas).

All information you provide during this registration process must be accurate, complete, and current, and you are responsible for keeping such information current and accurate for the duration of your registration. You agree not to impersonate any other person and to inform BNPP Cardif without delay of any change in the information you have provided to us. If applicable, you agree to process these changes yourself using the profile management area made available on the API Store.

Access to the API catalog requires an account on the API Store.

The latter must be requested by the partner from its BNP Paribas Cardif contacts.

Any employee of the partner who leaves the entity must explicitly submit a request for judicial closure to their BNP Paribas Cardif correspondent.

Username and password

Upon completion of your registration, you will receive a personal user ID and password (the "User Credentials"). The user credentials are and will remain the property of BNPP Cardif and you are granted a non-transferable license to use the user credentials for the sole purpose of participating in the API Store.

You should keep the user's credentials confidential and should not share the user's credentials with third parties. Each User is solely responsible for the use of his/her User Credentials. Any Use of the API Store, connection or data transmission made via the specific profile associated with the User Credentials will be presumed to have been made by that User and under his or her sole responsibility.

BNPP Cardif will not be responsible for the loss of the user's credentials. If you realize or suspect that your user credentials have been compromised, you should contact your BNP contact (CRDF.FRAPISTORE@bnpparibas.com) without undue delay. You must not attempt to circumvent or modify the user's credentials or any other security mechanism used by BNPP Cardif in connection with the API Store.

4. USE

As part of your use of the API Store, you can: • Access the documentation relating to the BNPP Cardif APIs; • Access data related to the BNPP Cardif APIs.

The API Store Cardif is composed of several pages. Certain sections or pages may be subject to separate terms and conditions, which are in addition to these Terms. You should make sure to read all additional terms carefully. By accessing and using any page, you agree to be bound by any applicable additional terms. In the event of a conflict, the additional terms will take precedence over these Terms.

The API Store is for viewing only, and does not allow transactions of any kind to be performed. The information provided on the API Store should not be construed as: • An offering of products or services; • A proposal or an inducement to enter into an insurance contract; • A recommendation; • All or part of a contract.

You may use the API Store only for lawful purposes. You must not use the API Store in any manner that violates: • Any applicable laws or regulations; • Is fraudulent or misleading; • Intentionally causes harm to BNPP Cardif or a third party.

Your use of the API Store also constitutes your acknowledgement that you have the necessary skills, training, and equipment to use the Services.

5. CONTENT AND AVAILABILITY OF BNP PARIBAS CARDIF

The purpose of the API Store Cardif is to provide you with information regarding the products and services offered by BNPP Cardif via the BNPP Cardif APIs.

Nothing contained on the API Store should be taken as legal, tax, accounting or financial advice and no information should be considered as such. It does not take into account the specific insurance objectives, or particular needs or abilities of any particular recipient and does not form the basis of, nor will it be relied upon, in connection with any contract or commitment. BNPP Cardif declines all responsibility for any decision made on the basis of the information contained on the API Store, as well as for the use that may be made of it by third parties.

BNPP Cardif endeavours to ensure unhindered access to the API Store, as well as a reasonable level of operation and availability. However, we do not guarantee that the API Store, or any content contained therein, will always be available or uninterrupted. Any unavailability and/or interruption may result from reasons such as maintenance, technical updates or improvements, or changes to the content and/or display of the API Store, as well as from any reason beyond BNPP Cardif's control, such as force majeure.

BNPP Cardif also reserves the right, at its sole discretion and without prior notice, to suspend and/or block access to the API Store in the event of a breach of these Terms or for any other reason, and/or to discontinue or modify any part of the API Store, including but not limited to the information contained on the API Store, The features of the API Store and the look and feel of the API Store.

We do not guarantee the accuracy, completeness, or appropriateness of any information relating to or in connection with the API Store. We are under no obligation to keep the API Store or any content up to date. As a result, the information on the API Store can be outdated at any time.

6. PROHIBITED CONDUCT AND CONTENT

You agree to comply with these Terms and all applicable laws and regulations when using the API Store Cardif. In particular, you agree not to:

(i) compromise, damage, disable, overburden, disrupt or interfere with the security or operation of the API Store, including the information and operating systems of BNPP Cardif or those of its potential service providers;

(ii) use or permit the use of the API Store in an abusive or unlawful manner, or for any illegal, fraudulent or malicious purpose, in any manner and form, including, but not limited to, hacking the API Store or introducing malicious code, including viruses, or harmful data into the API Store, using any system, device or program to extract data or information from API Store or BNPP Cardif's servers, sending or storing material that contains viruses, worms, Trojan horses or other malicious software, files, scripts, information agents or harmful programs, or interfere with or breach the integrity or performance of the API Store and any data contained therein;

(iii) attempt to gain unauthorized access to the API Store, its associated systems or networks, the server on which the API Store is stored, or any server, computer, or database connected to the API Store;

(iv) attack the API Store via a denial-of-service attack or a distributed denial-of-service attack;

(v) use any robot, spider, or other similar search application to retrieve or index the content;

(vi) reverse engineer, disassemble, reconstruct or decompile any Content;

(vii) engage in any activity that inhibits any other user from using the Content;

(viii) collect information about other users; or

(ix) link to any part of the API Store in any other website or application, unless you have the prior written consent of BNPP Cardif to do so, given that the API Store must not be framed on any other website or application.

It is recalled that it is a criminal offence to fraudulently access or remain in a computer system, to hinder or distort the operation of such a system, or to fraudulently introduce or modify data in a computer system. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a violation, your right to use the API Store will cease immediately.

BNPP Cardif will not be liable for any losses caused by a distributed denial-of-service attack, viruses or any other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the API Store or your downloading of any material posted thereon.

Failure to comply with these Terms may result in the termination or suspension of the User's right to use the API Store without prior notice, without prejudice to any other rights that BNPP Cardif may have, including the right to claim damages in legal proceedings.

7. INTELLECTUAL PROPERTY

BNPP Cardif and/or its licensors own all rights (including intellectual property rights), title and interest in and to any content or elements that make up the API Store, in particular the content, design and documentation of the API, as well as all information, data, designs, graphics, photographs, audio recordings and video recordings. All such rights, except those expressly granted, are reserved and the benefit of any goodwill resulting from the use of such rights shall accrue to BNPP Cardif.

Upon approval of your registration by BNPP Cardif, BNPP Cardif will grant you a limited, non-exclusive, non-transferable, revocable and non-sublicensable right to use the API Store for the duration of your registration for the sole purpose of participating in the API. The API Store in accordance with these Terms. In particular, under these Terms, you are limited to using the API Store for: (i) your internal personal and/or business use; and (ii) for the purposes listed in Section 4 only.

The Content of the API Store may not be reproduced, displayed, represented, distributed or transmitted to any other person by any means whatsoever, in whole or in part, without the express prior authorisation of BNPP Cardif. Content may not be taken out of context or presented in an inaccurate, misleading, unfair or discriminatory manner.

All trademarks (whether registered or not) used on the API Store are the property of BNP Paribas Cardif or its licensors. The trademarks may not be reproduced or used in any way, in whole or in part, without the prior authorisation of BNPP Cardif. You agree not to remove any copyright notice or other notice meaning the intellectual property rights of BNPP Cardif or any other third party.

Except as otherwise expressly provided herein, nothing in these Terms or in the content of the API Store shall be deemed or construed as granting any license or right expressly, implicitly or otherwise, to any intellectual property right of BNPP Cardif.

Any action in violation of this section would constitute a violation of the rights of BNPP Cardif and/or its licensors, and BNPP Cardif and/or its licensors may take appropriate legal action to enforce their rights.

8. EXCLUSION OF LIABILITY

To the extent permitted by applicable law and/or regulation, and subject to the limitation, neither BNPP Cardif nor any of its affiliates, agents, licensors, delegates, directors, officers or employees shall be liable for any loss (as defined in these Terms), including, but not limited to, losses incurred or suffered by you directly or indirectly in connection with:

(i) your use of or inability to use the API Store (whether in whole or in part and whether or not under the control of BNPP Cardif);

(ii) your use of or reliance on any content on the API Store;

(iii) the suitability, sufficiency, or otherwise of the API Store or the information contained in the API Store for a particular purpose;

(iv) any delays, errors or omissions regarding the content of the API Store;

(v) any information provided on the API Store is corrupted, erroneous, or inaccurate; or

(vi) acts or omissions of you or third parties, including, but not limited to, acts or omissions of third parties in creating the Store Cardif API and providing information for use on the Store Cardif API.

The API Store, any content, and any other information provided on the API Store are provided "as is" and use of the API Store is entirely at your own risk. We do not represent or warrant that this information is error-free, accurate or complete and you should not rely on it as such. BNPP Cardif has no obligation to change or update the information provided on the API Store. BNPP Cardif makes no warranty, express or implied, as to the fitness of the API Store Cardif for a particular purpose. BNPP Cardif does not make or provide any representations, warranties or conditions of any kind, implied, express or statutory regarding the API Store, including but not limited to the information or any details contained in or on the API Store.

Subject to the other terms of this section, BNPP Cardif's total aggregate liability for all losses arising out of or in connection with these Terms and the API Store shall not exceed €1,000. In the event of any inconsistency between this section and any other provision of these Terms, the terms of this section shall control.

You agree that the exclusions and limitations set forth in these Terms are reasonable in light of the nature of the API Store and the technology used to support the API Store (including the fact that the Internet is not a completely reliable medium of transmission).

9. CONFIDENTIALITY

The Internet and email may not be an appropriate way to send confidential information, as these communications may not be secure. BNPP Cardif therefore recommends that you do not use this means of transferring confidential information, unless additional security methods, such as encryption technology, are adopted. BNPP Cardif accepts no responsibility for confidential information sent to us via the Internet, by e-mail or via the API Store.

If, and to the extent that you receive any confidential information relating to or in connection with the API Store, you must treat such confidential information as strictly confidential and you may not disclose such confidential information to any third party. You agree to protect such information from unauthorized access and to treat it with the same care with which you would treat your own confidential information.

10. EXTERNAL WEBSITES

The API Store may contain links to external applications, websites and sources that are not controlled by BNPP Cardif. These applications, websites and sources, as well as the products and services contained therein, are not endorsed by BNPP Cardif, and BNPP Cardif has not verified the truthfulness, accuracy, authenticity or reliability of their content.

You use these applications, websites and sources at your own risk, as BNPP Cardif cannot control these applications, websites and external sources and therefore cannot be held responsible for the use, availability, information or content included therein, in particular with regard to their opinions, recommendations, advertisements, products or any other services available on or from them.

The API Store may also contain material provided by third parties. BNPP Cardif accepts no responsibility for the accuracy, authenticity or reliability of this material.

11. PRIVACY AND COOKIES

BNPP Cardif may process your User Data, including personal data, as part of and/or in connection with your Use of the API Store Cardif. This may include using cookies or similar technology to collect information about your Use of the API Store Cardif.

You accept that rejecting BNPP cookies in this way may mean that parts of the API Store Cardif may not function properly or be accessible.

12. END OF REGISTRATION

BNPP Cardif may terminate your registration and access to the API Store at any time without notice. Your registration will be automatically terminated if you violate any of these Terms. Upon termination, all rights granted to you under these Terms will automatically cease. This includes, but is not limited to, the right to access the API Store and any content provided therein. BNPP Cardif is not obligated to retain any data related to your registration after termination. You agree that BNPP Cardif shall not be liable for any loss or damage arising from the termination of your registration or access to the API Store. If your registration is terminated, you must immediately stop using the API Store and delete any content obtained through it.

13. CHOICE OF LAW

These Terms are governed by French law and you agree that the French courts will have exclusive jurisdiction to decide any question or dispute arising out of or in connection with the API Store or these Terms. If, for any reason, a court of competent jurisdiction finds any part of these Terms to be invalid, illegal or unenforceable to any extent, BNPP Cardif will delete the relevant part of the Terms and the remainder of the Terms will continue to be valid and enforceable to the fullest extent permitted by applicable law.

These Terms, together with any additional terms of the BNPP Cardif API Store, shall contain the entire agreement and understanding of the parties, and supersede all prior agreements, understandings or arrangements relating to the API Store.

You may download, print and store a copy of these Terms for your personal use only. These Terms may not be used or copied for any commercial or other purpose.
